Abstract

This study aims to analyze the position of the Honorary Board Decision Number 317-PKE-DPD / X / 2019 according to Law Number 7 of 2017 and the legal consequences of the Honorary Board Decision Number 317-PKE-DPD / X / 2019 after the Court's decision. State Administration number 82 / G / 2020 / PTUN.JKT. This research is a Normative research using a statutory approach (Statute approach).

A decision is the end of a legal issue which is usually called a Judge's Decision, in deciding a Judge's case Has several reasons or legal considerations used in resolving legal cases, In essence the judge's consideration is the basis for a decision that has legal force that is final and binding (last and binding).

The findings of this research is the implementation of the Presidential Decree, then the Decree of the President continued with the proposed lawsuit to the Administrative Court, hereinafter State Administration grant and cancel the presidential decree, then here appears a lot of legal gaps, causing many doors settlement issues, especially in election administrators and produce different solutions, this can make it difficult for the EMB in executing which decisions to follow. In order for judicial election polemics and conflicts do not occur that could have an impact on system of constitutional democracy, the government improve governance of elections, especially matters related to the settlement of electoral disputes.
