This study aims to find a legal principle the management and operation of gas flares (flaring and venting) on the Upstream Oil and Gas related policies or regulations regarding the production of gas is burned (flaring). The method research used is normative and prescriptive law. The peculiarity of this research is seeking the truth of coherence. This research uses a statute approach, a conceptual approach. However, an approach that is command and control is not enough if it is not combined with a comparative approach to regulations (micro-comparative) from several countries (comparative approach) as the largest oil and gas producer in the world, related to policies and regulations to reduce gas flaring, such as Canada, Russia, Kazakhstan and Qatar. These countries are using various measures to reduce gas flaring, which can be used as a reference for implementation in Indonesia. The findings of this legal research are that the principle of harmony is applied in the management of gas flares, the relationship of authority between the Central Government and the Provincial Government must be carried out in a harmonious manner in relation to the relationship of authority and utilization of natural resources in order to achieve equitable welfare.
